It is illegal to use the Society's funds for cultural events in societies

Now, the Government of Maharashtra has made the third amendment to the existing Cooperation Act

Members of many societies want to celebrate Satyanarayan worship, cultural events, fashion shows, sports events on behalf of the society through the fund of the society.  The Society is asking the District Housing Federation whether the funds can be used for the same.  It is necessary to state that the provision of utilizing such programs for the funds of the Society is not in the Co-operation Act or by-laws.  So in such a situation we should not organize worship, cultural events, sports competitions?  This is a question of members and societies.  There is no opposition to co-operation laws and bylaws for the members of the societies to organize such programs by themselves.  Only Independence Day

Society can spend the flag on the occasion of Independence Day (15th August), Republic Day (26th January), Maharashtra Day (1st May).  However, the Society cannot spend its funds for Satyanarayana Puja, Meal, etc. on the occasion of this national festival;  Even the Annual General Meeting cannot pass such a resolution.  If such a resolution is passed, that resolution may be invalidated and its burden falls on the members of the management committee.

Society needs to note that there are separate bylaws to spend funds for the demolition, major repairs, etc. of the Society's building.  If rain water leaks through the roof of a building, the Society's funds can be used to repair the roof.  But the Society's funds could not be spent to build a sheet shed on the terrace.  For this, all members of the society are required to give equal participation.

In such a situation, spending of the Society's funds for cultural programs was far from over.  Therefore, the office bearers, directors and general members of the society should study the by-laws.  The Thane Housing Federation feels that books of by-laws are sold in large quantities.  However, the book of by-laws purchased once does not open.  The reason for such a conclusion is that through the letters of the societies they are constantly asking what is the by-law that addresses the grievances.  Now, the Government of Maharashtra has made the third amendment to the existing Cooperation Act.  Detailed articles about it have been published in newspapers from the official magazine of the District Housing Federation.  One thing to note here is that ignorance of the law cannot be the cause.  Because the functioning of the society is governed by the rules and regulations of the cooperative.  Under subsection No.1, the concerned may be fined Rs.5,000 for any breach of any of the bylaws, by the office bearers or members.
